Welcome to 9Horsemen, an AI-powered meme generation platform. By accessing or using our website or services, you agree to these Terms & Conditions ("Terms"). Please read them carefully.


0. Definitions

  • “AI-generated content”: Any image, meme, or output generated by 9Horsemen’s AI systems based on user input.

  • “User input”: Any prompt, idea, or text entered into the platform.

  • “Commercial use”: Any use involving direct or indirect monetization, including ads, sponsorships, affiliate links, or merchandise.

  • “Personal use”: Non-commercial sharing with friends, family, or on social media without monetary intent.

  • “Hotlinking”: Embedding a meme hosted on 9Horsemen’s servers directly into an external website via its image URL.


1. Intellectual Property & Usage Rights

1.1 Ownership

All AI-generated content, templates, logos, and designs produced on this platform remain the exclusive property of 9Horsemen. Users do not gain ownership rights, including to customized or modified versions.

1.2 Permitted Use

You may:

  • Use memes for personal, non-commercial purposes.

  • Share memes on non-monetized personal social media.

You may not:

  • Use content for commercial gain (ads, sponsorships, monetized pages) without a valid license.

  • Use the platform to train, fine-tune, or enhance other AI systems.

1.3 Copyright Status

AI-generated content may not qualify for copyright under NZ, US, or EU law. You may not attempt to register or claim ownership of such content.


2. Hotlinking & Attribution

If you embed (“hotlink”) a meme image from 9Horsemen into another website or platform, you must:

  • Include a visible hyperlink back to https://9horsemen.com or the original meme generation page.

  • Not alter, obscure, or remove the image URL source or branding.

We reserve the right to remove images that are hotlinked without proper attribution.


3. Prohibited Activities & Enforcement

3.1 Prohibited Uses

You may not:

  • Resell, commercialize, or distribute our content without a license.

  • Create or share content that is illegal, harmful, offensive, discriminatory, or defamatory.

  • Reverse-engineer, copy, scrape, or misuse our platform or its systems.

3.2 Enforcement

  • First violation: Warning and removal of offending content.

  • Repeat or severe violations: Account termination and possible legal action. Statutory damages may apply (up to NZ$5,000 per violation).

  • Criminal acts may be reported to law enforcement.


4. User Conduct

You agree not to:

  • Harass, bully, or impersonate others.

  • Post or generate sexually explicit, hateful, or politically violent content.

  • Violate the rights or dignity of any group or individual.

4.1 Moderation Rights

We reserve the right (but not the obligation) to review, moderate, and remove content that violates these Terms or harms the platform experience. Content moderation may be automated or manual.


5. Platform License

We grant you a limited, non-transferable, non-exclusive, revocable license to use our services solely as permitted under these Terms. This license is for personal or approved commercial use and may be revoked if misused.


6. Limited Marketing Use of Public Memes

If you generate and publicly share a meme on 9Horsemen, we may feature selected memes:

  • In marketing materials (website, blog, social media)

  • With credit where applicable

  • Never in a way that misrepresents or mocks the user

7. Liability & Disclaimers

7.1 “As Is” Use

All services are provided “as is.” We make no guarantees about the accuracy, completeness, or reliability of generated content.

7.2 Liability Cap

To the extent allowed by law, 9Horsemen’s liability will not exceed NZ$500.

7.3 User Indemnification

You agree to indemnify 9Horsemen for any claims, losses, or legal costs (NZ$500/hr) arising from your misuse of the platform.


8. Data & Privacy

8.1 Collection & Deletion

We collect minimal user data (e.g., prompt text, timestamps), which is deleted after 30 days. All data is encrypted in transit and at rest.

8.2 Cookies

Only essential session cookies are used. No ad trackers or third-party pixels.

8.3 Rights

Users can request data access, correction, or deletion via privacy@9horsemen.com.
We comply with NZPA, GDPR, and CCPA.
Children under 13 are not permitted in accordance with COPPA.


9. AI Training Disclosure

We train our models only on:

  • Public domain (CC0) content

  • Licensed datasets (see: legal.9horsemen.com/licenses)

For takedown requests, contact copyright@9horsemen.com with proof of ownership.
False claims may incur a NZ$500 administrative fee.


10. Dispute Resolution

10.1 Arbitration Clause

All disputes will be resolved via binding arbitration in Auckland, New Zealand.
Class actions are not permitted.

10.2 Legal Fees

Frivolous or failed legal claims may result in you being liable for our legal fees, up to NZ$2,000.


11. User-Generated Content

  • You retain rights to your prompt text.

  • We do not own your inputs, but we may remove content that violates our Terms.

  • Inputs are auto-deleted after 30 days.


12. Account Termination

You may terminate your account at any time by emailing support@9horsemen.com.
We may suspend or terminate accounts that violate these Terms.
Data is retained for no more than 30 days after termination unless legally required.


13. Changes to the Platform

We may modify, add, or remove features at any time.
We are not liable for outages, discontinued tools, or removed content.
You may stop using the platform at any time.


14. DMCA Compliance (for US Users)

We comply with the Digital Millennium Copyright Act (DMCA).

15. Agreement & Revisions

By using 9Horsemen, you agree to these Terms via a clickwrap agreement.
These Terms are reviewed annually by a registered New Zealand IP law firm.
Updates will be posted on the site. Continued use after an update implies acceptance.
